DISCLAIMER

Any and all rules governing the use of the Pool and Recreation and Common Areas of the Wood Farm Homeowner’s Association will be determined by the Board of the Wood Farm and Cloisters Homeowner’s Association, Inc; hereinafter referred to as the Board and/or the Board of the Homeowner’s Association. The Board has complete unilateral authority to set forth and/or change any and all rules governing the use of the Pool and its surrounding area as it sees fit to do so in its function to protect and preserve Association assets for the use and enjoyment of all residents of Wood Farm Subdivision and the Cloisters at Wood Farm. In addition to setting rules for the use of the Pool and its surrounding area, the Board has the authority to limit or suspend for a period of time the pool privileges of residents who violate these rules.

  1. Admittance permitted only to residents in good standing, and their accompanied guests. Any resident or Board member is authorized to inquire as to the status of any individual using the pool. Please direct any key fob requests to poolpond@woodfarmhoa.com

  2. No children under the age of 15 will be permitted in the fenced pool area without a parent or guardian (18 years or older) present

  3. All children must be supervised. Children who are not toilet trained must wear swim diapers along with plastic-lined or rubber swim pants in the pool.

  4. Shower before entering the pool.

  5. Bathing suits must be worn in the Pool. Cut-offs, street clothes and inappropriate swimwear, including but not limited to thong bathing suits, are not allowed in the pool. The Board will decide the determination of whether or not something is appropriate swimwear, in cases of dispute.

  6. No person with skin, ear, nasal infection, or communicable disease is allowed in the pool.

  7. Water wings, children’s small round floats, snorkel tubes, face masks, and water fitness equipment are permitted in the pool. Extra-large flotation devices and toys not specifically made for use in pools are not allowed.

  8. No horseplay in the pool area, such as: running, pushing, jumping in the pool onto others, dunking, or holding others underwater.

  9. Spitting, spouting of water, blowing the nose, etc. in the pool is prohibited.

  10. Solo swimming by anyone younger than 18 years of age is not permitted. ANYONE 18 YEARS OR OLDER WHO CHOOSES TO SWIM SOLO DOES SO AT HIS OR HER OWN RISK.

  11. Diving is not permitted. The pool is not of sufficient depth to dive safely.

  12. No pets, bicycles, skateboards, roller blades, or skates are allowed in the pool area.

  13. No glass of any kind is permitted in the pool area.

  14. Radio volume must be kept to a minimum at all times, and no loudspeakers are allowed without first receiving written permission from the Board.

  15. No foul, profane, or abusive language will be tolerated.

  16. No items belonging to the Wood Farm Homeowner’s Association, Inc. shall be removed from the pool or amenity area without first receiving written permission from the Board.

  17. Any food or drink items taken into the pool or surrounding area must be removed by the individuals who brought them in. Place all trash in the designated containers.

  18. No alcoholic beverages are allowed for anyone under the age of 21. Containers of alcoholic beverages should be kept concealed. No person under the influence of alcohol or drugs will be permitted in the pool, the pool area, or any of the recreational areas of the Wood Farm Homeowner’s Association.

  19. Each family unit/resident will be limited to one cooler not larger than 28 quarts. The only exception being the case of a resident reserving the Cabana for a party, in which case the size of the cooler is not limited but must remain in the area of the cabana and be removed upon the conclusion of the party.

  20. The health and safety of the Wood Farm and Cloisters Homeowners and their guests in the around the pool areas are ultimately their own responsibility. Wood Farm Homeowners Association, Inc. assumes no responsibility for the loss of or damage to personal property or any accident or injury that occurs in or around the pool and bathhouse.

  21. The pool is an amenity strictly for Homeowners that live in Wood Farm and the Cloisters at Wood Farm and who are current on their dues, with the exception of swim team members (see paragraph 25 below for clarification concerning swim team formation, activities and membership). Residents can host up to, but no more than, five (5) invited guests, (meaning no more than five guests per family unit or resident unit) to swim with them in the pool at any one particular time. Invited guests, who are overnight guests, are not limited to the number of visits per season. A WOOD FARM RESIDENT MUST ACCOMPANY INVITED GUEST AT ALL TIMES.

  22. There will be no exclusive parties or reservations allowed where general access of all Wood Farm and Cloisters residents is restricted. Reservations of the cabana area (picnic area) will be allowed by calling and reserving it with the person designated by the Board to receive such reservations. Any resident wishing to reserve this area for a party will be required to post a clean-up deposit of $150.00. $75 will be returned to you provided there is no damage. All clean up and removal of all trash generated by the party or activity will be the responsibility of the resident making the reservation. Cleanup is required to be completed by the close of the pool the day that the party takes place. If the cleanup is inadequate or insufficient it will result in the forfeiture of the clean-up deposit, (meaning that the HOA will keep the $150). If the resident affects the proper cleanup, $75 of the deposit check will be returned to the resident. IN CASES OF PARTIES ONLY, A HOMEOWNER WHO RESERVES THE CABANA AND PAYS THE REQUIRED CLEAN UP DEPOSIT, WILL BE ALLOWED TO HOST UP TO TEN (10) INVITED GUESTS FOR THE TIME PERIOD OF THE PARTY.

  23. Each swim season, residents will be issued a Key fob identification card (the Board has the sole authority to decide the form of identification to be used and can choose the form of an ID card, bracelet, or any other form of ID that it deems to be appropriate). Each resident (or resident household) will be required to carry this card while using the pool. Each season, prior to being issued their card, each resident (or head of household) will be required to sign an acknowledgement that he or she has read the rules governing the use of the pool and that he or she and their entire household, including invited guests, agrees to abide by and help enforce said rules for use of the pool. No resident will be issued a card until they have signed said acknowledgement. In the event that any resident does not sign and agree to said rules, their privileges will be suspended until such time as they do sign. Any person or persons unable to produce or show a valid, current ID card will be required to leave the pool area. Any resident or board member is authorized to ask any person present in the pool area to produce a valid, current ID card.

  24. In the event that there is a desire from within the community to have a swim team the Board has the authority to set forth rules governing the use of the pool and pool area for special activities including swim team practices, events and meets. The Board also has the authority to open up membership of the swim team to non-residents who, for a fee, will pay to participate in a Wood Farm Subdivision swim team. The use of the pool for these nonresidents will be strictly limited to authorized swim team events including practices and meets. Each year that there is to be a swim team the Board will name a swim team manager and approve all schedules, expenses, fees, hours of use, etc. for the activities of said swim team. ONLY IN THE CASE OF SWIM TEAM PRACTICES AND MEETS AND ONLY WITH THE AUTHORIZATION OF THE BOARD WILL THE POOL BE CLOSED TO GENERAL ACCESS BY RESIDENTS.

  25. The lake and surrounding recreational areas are for the exclusive use of the residents of Wood Farm and The Cloisters of Wood Farm. There is no limit to visits for invited guests, but a resident must accompany invited guest at all times. Wood Farm Homeowner’s Association makes no type of warranty or guarantee of the quality or safety of eating fish caught in the lake. Anyone who consumes fish taken from the lake does so at his or her own risk.

RESPONSIBILITIES OF MEMBERS OF HOMEOWNER’S ASSOCIATION

  1. All members assume responsibility for all loss or damage to personal property. Wood Farm Homeowner’s Association will not be responsible for any loss or damage to personal property.

  2. Members will be responsible to the Association for any debts, damage or breakage caused by them, their dependents or guests.

  3. Association members covenant and agree to report, in writing, to the Board any violations of these rules and regulations, including complaints of a member’s or guest’s conduct.

  4. Infractions of any pool rules can result in suspension of pool privileges.

  5. Members who bring to the pool anyone who lives in Wood Farm and The Cloisters who is not in good standing (i.e., past due on dues or below suspension of privileges) will be subject to suspension of pool privileges.

  6. Vandalism and/or destructive behavior by anyone using the pool or any of the common areas will not be tolerated. Individuals committing or participating in such behavior will be subject to suspension of pool privileges and possible prosecution under applicable law.

  7. All members are responsible for being aware of these rules and regulations and to adhere to them at all times.

  8. All members covenant and agree that from time to time, as the Board sees fit, these rules will be changed and/or new rules added to ensure sound management practices of the pool and amenity areas.
